Open source heading for a licensing train wreck?

Here come the judge According to an article posted to the RegDeveloper; and found via a good friend’s blog, the whole Open Source movement could be facing a big problem with their licensing model.

In a case that has gone before the US District Court for the Northern District of California the idea that the license used by Robert Jacobsen; and the Java Model Railroad Interface Project, might have been violated by Kamind Associates but that any transgression was a breach of contract, not a copyright violation.

To sum up, the court made two important holdings concerning the open source license involved here: 1) it is a contract; and 2) the attribution requirement was a condition of the contract, rather than a restriction on the scope of the license.

The article goes on to say that it is still early in the case and that proponents of the Open Source license involved are pushing for the community to get involved as they feel that there is a lot at stake here.
