If you are using Canada as an example please try to base your reasoning on facts

Don’t get me wrong, I like it when I see Canada make it into the tech news but what I don’t like is when a writer takes a situation in this country and uses to validate some line of thinking in a post – without checking some simple facts.

The latest incident of this is a post at ReadWriteWeb by Dan Rowinski where he was talking about the sale of Hulu and the implication of that sale on the future of the web. In the post he points to Canada as an indicator of what his fellow American can expect.

To be fair he is partly right but really for all the wrong reasoning.

Dan is right that if Americans want to see what their Internet future is like just look north; but it has nothing to do with Hulu but something that has already happened in the US. I am talking of course about the purchase of NBC by Comcast and the dangers of a carrier owning a major content producer.

While everyone else might like Facebook’s changes Canada isn’t happy

Everyone else in the world might be pleased as punch over some sort of perceived victory as Facebook announced changes to its privacy controls available to users but it seems that Canada’s Privacy Commissioner isn’t so happy.

This isn’t the first time that Facebook has come up against Canada’s Office of the Privacy Commissioner as back during last years investigation into Facebook’s privacy faux pas the companywas forced into making some ground breaking changes. Under the terms of the settlement Facebook agreed to comply with Canada’s privacy laws thereby by giving Canadians full control over how their data was to be shared.

Facebook did indeed fine tune the privacy settings in response to the probe and the regulator gave Facebook until August to introduce other protections. However within hours of Zuckerberg’s announcement today of coming changes Ms Elizabeth Denham, the Assistant Privacy Commissioner, said that while Facebook may have dialed it back the Privacy Commissioner didn’t feel that it was enough … “we don’t think users are comfortable.”

She said Facebook’s new settings continue to require users to publicly reveal their names, profile information, pictures, gender and networks to the broader Internet. Under Canadian law companies are bound to give consumers full control over how their personal data is used.

Another issue is Facebook’s recent move to allow outside software developers to cull users personal data and track their Internet movements. Facebook had committed last year to give members the ability to block such Internet trespassing by August.

“We are still waiting for Facebook to honour all of its commitments. I am disappointed in the direction they have taken,” Ms. Denham said.

Somehow I don’t think this confrontation with our Privacy Commissioner is over yet – not by a long shot.

When the ISPs worry about ACTA you know we’re in deep shit

I have written quite a bit about the whole ACTA mess because to me this is one of the most dangerous pieces of global trade laws that has ever been put together. It is well documented that the driving force behind ACTA has been the US entertainment industry that is looking to grab as much control of the Internet under the guise of protecting antiquated copyright laws. However that is only part of what ACTA is intended for.

It is the other part that according to Prof. Michael Geist that has Ken Englehart concerned. So why should it matter what some guy by the name of Englehart thinks about ACTA? Well Mr. Englehart is the Senior VP Regulatory for Rogers Communications which is one of Canada’s largest ISPs.

In a recent appearance before the Standing Committee on Canadian Heritage Mr. Englehart, in a reply to a question from NDP MP Charlie Angus, said the following

We are concerned, as many ISPs are, about the ACTA negotiations. It’s supposed to be about counterfeiting, but it seems to have gone way past counterfeiting to talking about issues of ISPs and the downloading activities of our customers. We don’t think ISPs should be put in the position of being traffic cops to decide what is legal and what is not. We really hate any idea that we would have to terminate our customers’ service on a three-strikes policy. We do not want to do that at all. I have a great deal of sympathy for the copyright holders who feel that their content is being stolen. It’s a big problem. But I don’t want to see this done by putting ISPs in the position of having to disconnect their customers or aid in the conviction of their customers.

When you have one of the greediest of an already greedy bunch of ISPs voicing concern over something like ACTA you have to know that this isn’t a good thing.

Seriously people you really need to get involved in stopping this thing before it gains even more traction than it already has. If you do want to get involved Professor Geist’s blog is the best place to start becuse we are all going to get screwed if we don’t.
